Terms of Service

1. Acceptance of Terms

By accessing or using any Red Lobsta product or service — including LobstaCloud, LobstaKit, and LobstaBox (collectively, "the Services") — you agree to be bound by these Terms of Service. If you do not agree, do not use the Services. The Services are operated by Red Lobsta ("we", "us", or "our") at redlobsta.com.

2. Description of Services

Red Lobsta offers multiple ways to deploy and use personal AI assistants:

  • LobstaCloud — A managed SaaS platform for deploying and operating Lobsta AI assistant instances in the cloud. We provision, maintain, and manage all infrastructure on your behalf.
  • LobstaKit — Open-source, self-hosted software distributed under the MIT License. You install and run it on your own hardware (e.g., Raspberry Pi, Linux server).
  • LobstaBox — A plug-and-play hardware appliance pre-configured to run Lobsta. Includes the physical device and pre-installed software.

3. User Accounts

You must create an account to use LobstaCloud. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.

4. Subscription & Billing (LobstaCloud)

LobstaCloud operates on a subscription basis. By subscribing, you agree to the following:

  • Plans are billed monthly or annually in advance via Stripe.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Pro-rated refunds are available within 14 days of a new subscription or renewal. See our Refund Policy for details.
  • We reserve the right to change pricing with at least 30 days' notice. Existing subscriptions will be honored through the current billing period.
  • Failure to pay may result in suspension or termination of your instances.

5. Hardware Purchases (LobstaBox)

LobstaBox purchases are subject to the following terms:

  • Pre-order deposits are fully refundable before the unit ships.
  • Delivered units may be returned within 30 days for a full refund, provided they are in original condition.
  • Hardware warranty covers manufacturing defects for 1 year from delivery.
  • Shipping costs for returns are the buyer's responsibility unless the item is defective.

6. Open-Source Software (LobstaKit)

LobstaKit is distributed under the MIT License. You are free to use, modify, and distribute the software in accordance with that license. Red Lobsta provides LobstaKit "as is" without warranty. Community support is available via GitHub and Discord; paid support is not included with the open-source license.

7. API Credits & Usage

Certain features may consume API credits or usage-based resources (e.g., AI model calls, compute time). API credits are non-refundable once consumed. Usage limits depend on your plan tier. Exceeding your plan's included usage may result in overage charges or throttling, as specified in your plan details.

8. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation.
  • Infringe on the intellectual property or privacy rights of others.
  • Distribute malware, spam, or engage in phishing.
  • Attempt to gain unauthorized access to the Services or related systems.
  • Abuse compute resources, including cryptocurrency mining on LobstaCloud infrastructure.
  • Harass, abuse, or harm other users or individuals.
  • Generate or distribute illegal content through AI instances.
  • Resell or sublicense access to the Services without written permission.

9. Data and Privacy

Your use of the Services is governed by our Privacy Policy. You retain full ownership of all data you store on or process through the Services. We do not access your data except as necessary to provide the Services, at your request for support, or as required by law.

10. Service Availability

We strive to maintain high availability for LobstaCloud but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We are not liable for damages arising from service interruptions, data loss, or downtime. For self-hosted products (LobstaKit, LobstaBox), availability depends on your own infrastructure.

11. Termination

Either party may terminate this agreement at any time:

  • You may cancel your account through the dashboard or by contacting support.
  • Upon cancellation, your access to LobstaCloud will continue until the end of your billing period.
  • After termination, your data will be retained for 30 days, then permanently deleted.
  • We may suspend or terminate your account immediately for material violations of these terms, including non-payment, abuse, or illegal activity.
  • Termination does not affect your right to use LobstaKit under the MIT License.

12. Limitation of Liability

To the maximum extent permitted by law, Red Lobsta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity arising from your use of the Services. Our total liability for any claim related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

13. Indemnification

You agree to indemnify and hold harmless Red Lobsta, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Services, your violation of these terms, or your violation of any third-party rights.

14. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware, unless otherwise required by applicable consumer protection laws in your jurisdiction.

15. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or through the Services at least 30 days before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the revised terms.
